Update: Marc Raimondi of ESPN reported more information about the arrest, citing the arrest report from Florida Highway Patrol. According to the report, Hardy’s car was “swerving” and “running off” the road, and when an officer engaged him, Hardy seemed to be “in a stupor and confused.” Additionally, once he stepped out of his vehicle, Hardy smelled of alcohol, and he could not successfully complete any sobriety exercises “without risk of falling.” Finally, after he took a breath test, the first sample showed that Hardy’s blood-alcohol contest was 0.294; the second test read 0.291. In Florida, the legal limit to drive is 0.08.
Once he left his car, Hardy was unsteady and smelled of alcohol, per the report. Officers, through conversation, learned Hardy had been drinking. Hardy could not complete any portion of sobriety exercises successfully “or without risk of falling,” the officer wrote in the report.
